Introduction

These Terms and Conditions (Terms) set out the agreement (Agreement) between Kangaroo Building Works
(ABN: 33623661342) and the customer (“you” or “Customer”) for the provision of repair, maintenance, and building services.

By engaging us for any services, whether verbally, through email, through our website https://kangaroobuildingworks.com/, or by accepting a quote, you agree to be bound by these Terms.

1.) Services and Quotes

a.) Kangaroo Building Works provides building repairs, maintenance, and related services for residential and commercial properties.

b.) All quotes provided are valid for 30 days unless otherwise specified.

c.) Quotes are based on the information provided by you and may be subject to change if additional issues or changes in scope arise.

d.) Acceptance of a quote (via approval, email, SMS, or payment) constitutes agreement to proceed under these Terms.

2.) Fees, Invoicing & Payments

a.) A deposit may be required before work commences. The balance is due on completion unless otherwise stated in the invoice.

b.) All payments must be made in Australian dollars via the payment method noted on the invoice (e.g., EFT, card, or cash).

c.) If additional materials or work are required, you will be notified and quoted accordingly before proceeding.

d.) Overdue invoices may incur a late fee of 10% per annum (accruing daily). We reserve the right to pause work or pursue recovery action for non-payment.

e.) All amounts exclude GST unless otherwise stated.

f.) Refunds are not issued unless required by law or agreed upon in writing.

3.) Scope and Variations

a.) The agreed scope is outlined in your quote. Any changes to scope must be discussed and agreed in writing.

b.) Additional services outside of the agreed quote may incur additional charges.

c.) We reserve the right to decline a request for variation if it cannot be accommodated.

4.) Materials and Customer-Supplied Items

a.) If we source materials on your behalf, you are liable for their cost once ordered.

b.) If you supply your own materials or products, we are not responsible for defects or installation issues related to those items.

5.) Access and Site Conditions

a.) You agree to provide safe, clear, and legal access to the site during working hours.

b.) You are responsible for disclosing any known hazards or risks at the property.

c.) We may suspend work if the site is unsafe or not ready. Any delays due to site issues may incur additional costs.

d.) The client is responsible for handling, securing, or keeping away pets and minors from the work area. Any damage or harm caused due to the interference of pets and minors, Kangaroo Building Works will not be liable for that.

e.) We strongly advise clients to keep their pets and minors away from our staff, tools, and work area when we are visiting your property. It will help to increase the safety of both parties.

6.) Completion Timeframes

a.) While we aim to meet estimated timeframes, all time estimates are indicative only and subject to change.

b.) We are not liable for delays caused by factors beyond our control, including weather, access issues, or supply delays.

7.) Warranties and Liability

a.) We provide a workmanship warranty for repairs and installations we complete, subject to fair use and maintenance.

b.) Warranty does not apply to: i.) Faults caused by misuse, neglect, or external impact ii.) Customer-supplied items or materials iii.) Pre-existing damage or unrelated defects

c.) Under Australian Consumer Law (ACL), you are entitled to certain guarantees. These Terms do not exclude any rights that cannot be excluded under the ACL.

d.) To the extent permitted by law, our liability is limited to: i.) Re-supply of the services, or ii.) Payment for re-supply of the services

e.) We are not liable for indirect or consequential losses.

8.) Defects & Claims

a.) You must notify us in writing of any issues or defects within 7 days of service completion.

b.) We will assess and, if required, rectify genuine defects in workmanship as quickly as practical.

c.) Claims lodged outside the reasonable time window may be treated as a new scope of work.

9.) Termination

a.) We may terminate the Agreement immediately if: i.) Payment is not received within the agreed terms ii.) You breach any provision of these Terms

b.) You may cancel the services only before work begins, and may incur costs for time or materials already committed.

10.) Ownership of Goods

a.) Any materials or goods supplied remain the property of Kangaroo Building Works until full payment is received.

b.) Risk passes to you on delivery or installation.

11.) Force Majeure

We are not liable for any failure or delay in performance due to events beyond our control, including but not limited to natural disasters, government restrictions, illness, or supply chain disruptions.

12.) Disputes

a.) If a dispute arises, both parties agree to attempt to resolve it in good faith via direct negotiation.

b.) If unresolved, the parties agree to participate in mediation through a neutral third party.
